Exhausted and disillusioned, Fleming retreated to his Jamaican estate, Goldeneye, where he reworked the abandoned screenplay into a novel\u2014<em data-start=\"1007\" data-end=\"1020\">Thunderball<\/em>. When the book was published in 1961, Fleming made a catastrophic decision: he credited only himself.<\/span><\/p>\n<p data-start=\"1124\" data-end=\"1153\"><span style=\"font-size: 14pt;\">McClory and Whittingham sued.<\/span><\/p>\n<p data-start=\"1155\" data-end=\"1518\"><span style=\"font-size: 14pt;\">The resulting plagiarism trial in London\u2019s High Court in November 1963 was brutal and public. Friends later described him as \u201cwounded\u201d and \u201chumiliated,\u201d devastated by the idea that part of James Bond\u2014his life\u2019s work\u2014legally belonged to someone else.<\/span><\/p>\n<p data-start=\"1520\" data-end=\"1963\"><span style=\"font-size: 14pt;\">The physical toll was immediate. During the proceedings, Fleming suffered two heart attacks. His friend <strong data-start=\"1624\" data-end=\"1665\"><span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">Ivar Bryce<\/span><\/span><\/strong> ultimately convinced him to settle rather than risk death in court. The agreement was crushing: Fleming paid McClory \u00a335,000 (roughly $50,000 at the time) plus court costs and, more damagingly, surrendered the film and television rights to <em data-start=\"1906\" data-end=\"1919\">Thunderball<\/em>\u2014including SPECTRE and Ernst Stavro Blofeld.<\/span><\/p>\n<p data-start=\"1965\" data-end=\"2020\"><span style=\"font-size: 14pt;\">That legal loss haunted the Bond franchise for decades.<\/span><\/p>\n<p data-start=\"2022\" data-end=\"2361\"><span style=\"font-size: 14pt;\">Just nine months after the trial ended, on August 12, 1964, Fleming suffered a fatal heart attack at age 56. The timing was bitterly ironic. He died only weeks before <strong data-start=\"2189\" data-end=\"2230\"><span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">Goldfinger<\/span><\/span><\/strong>\u2014the film that would transform Bond into a global phenomenon\u2014hit theaters. Fleming never saw the full scale of the empire he built.<\/span><\/p>\n<p data-start=\"2363\" data-end=\"2666\"><span style=\"font-size: 14pt;\">The lawsuit\u2019s shadow stretched far beyond his death.
